OverPocket Terms of Service

Welcome to OverPocket. These Terms of Service ("Terms") govern your access to and use of the OverPocket mobile application, website, and related services (collectively, the "Service"), operated by Overpocket Inventory ("OverPocket," "we," "us," or "our").

By creating an account or using OverPocket, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of the Service

OverPocket is a personal and household inventory management application that allows users to catalog belongings, organize storage locations, search for items, and manage inventory through photographs, text, and voice commands.

Depending on your subscription and available features, OverPocket may provide:

• AI-assisted identification and categorization of photographed items.
• Natural-language inventory creation, searching, and updates.
• Cloud storage, synchronization, and backup.
• Shared household inventories.
• Other inventory-management features.

Features may change over time.

2. Eligibility and Accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account.

You agree to provide accurate account information, maintain the confidentiality of your login credentials, and notify us of suspected unauthorized access.

You are responsible for activity conducted through your account, except where applicable law provides otherwise.

3. Your Content

You retain ownership of the photographs, descriptions, inventory records, location information, and other content you submit to OverPocket ("User Content").

You grant OverPocket a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display User Content solely as reasonably necessary to provide, maintain, secure, and improve the Service, consistent with our Privacy Policy.

We do not acquire ownership of your belongings or inventory records.

You represent that you have the rights necessary to submit your User Content and that doing so does not violate applicable law or third-party rights.

4. AI-Powered Features

OverPocket may use artificial intelligence to identify objects, generate descriptions, assign categories, interpret voice commands, and suggest inventory changes.

AI-generated results may be inaccurate, incomplete, or misleading. You are responsible for reviewing and confirming important inventory information.

OverPocket does not guarantee that any item will be identified correctly or that inventory records accurately reflect the physical location, condition, quantity, or ownership of an item.

Do not rely on OverPocket as the sole record for insurance claims, legal proceedings, emergency preparedness, or other high-stakes purposes.

5. Shared Households

OverPocket allows a household owner with an active Pro entitlement to share an inventory with up to five invited members.

Household owners manage invitations and membership. Authorized members can view and manage shared inventory while the owner's subscription is active. Members do not need a separate subscription to use the household's shared features. If the owner's subscription expires, shared inventory becomes read-only.

Content added to a shared household may be accessible to other authorized household members.

You are responsible for choosing whom to invite and understanding the permissions granted to them.

Removing a household member prevents future authorized API access but does not erase information already downloaded or cached on their devices. Previously issued photo links may remain valid for up to five minutes.

Joining a household replaces your previous inventory, rather than merging it. The application asks you to confirm deletion before joining.

6. Subscriptions and Payments

OverPocket offers free features and a paid Pro subscription. Manual inventory, ordinary text search, and item photo attachments do not require Pro. AI features and household invitations require an active Pro entitlement or, for shared AI access, membership in an active Pro household.

Paid subscriptions may be billed monthly or annually through Apple's App Store or another supported payment provider.

Before purchasing, you will be shown the applicable subscription price, billing period, and any available introductory offer.

Automatic Renewal: Unless canceled, subscriptions automatically renew at the end of each billing period at the applicable price, subject to required notice and applicable law.

Cancellation: For subscriptions purchased through Apple's App Store, you can manage or cancel your subscription through your Apple account's subscription settings. Deleting the OverPocket application does not automatically cancel your subscription.

Free Trials: If a free trial is offered, its duration and eligibility will be displayed before purchase. Unless canceled before the trial ends, the subscription may convert to a paid subscription as disclosed at checkout.

Refunds: Purchases made through Apple's App Store are generally subject to Apple's refund procedures and applicable law.

OverPocket may change subscription pricing or features, subject to required notices, platform rules, and applicable law.

If your subscription expires or is canceled, premium features may become unavailable. We will not intentionally prevent you from accessing or exporting your existing inventory solely because your subscription expires, provided your account remains active and the applicable functionality is available.

7. Acceptable Use

You agree not to:

• Use OverPocket for unlawful or fraudulent purposes.
• Access another person's account or inventory without authorization.
• Interfere with the security or operation of the Service.
• Attempt to bypass subscription, authentication, or usage restrictions.
• Upload malicious code or content that violates applicable law.
• Use automated methods to abuse the Service or its infrastructure.

We may suspend or restrict access where reasonably necessary to protect users, enforce these Terms, or comply with law.

8. Service Availability and Data Protection

We work to maintain the availability and security of OverPocket, but we do not guarantee uninterrupted or error-free operation.

Cloud synchronization may be delayed, and conflicts may occur when multiple devices or household members modify the same records.

You should maintain independent records or backups of information that is especially important to you.

9. Intellectual Property

OverPocket's name, logo, software, interface, design, and other proprietary materials belong to Overpocket Inventory or its licensors.

These Terms grant you a limited, nonexclusive, nontransferable, revocable license to use the application for its intended purposes, subject to applicable law and platform terms.

10. Account Termination and Deletion

You may request deletion of your account by emailing info@stow.house. We will verify your identity and complete the request within 30 days, subject to applicable legal retention requirements. Account deletion is currently handled by support, not by an in-app deletion button.

Account deletion may result in permanent loss of personal inventory data, subject to applicable retention obligations.

Shared household data may remain available to a continuing household when a member deletes their account. If you own a household, contact support to discuss the effect of deletion on its members and shared records before proceeding, as described in our Privacy Policy.

We may suspend or terminate accounts for material violations of these Terms, subject to applicable law.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DO NOT WARRANT THE ACCURACY OF AI-GENERATED RESULTS, THE COMPLETENESS OF INVENTORY RECORDS, OR THE AVAILABILITY OF THE SERVICE.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OVERPOCKET AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO OVERPOCKET DURING THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply where prohibited by law.

13. Changes to These Terms

We may update these Terms to reflect changes in the Service, applicable law, or business practices.

When changes are material, we will provide notice as required by law. The updated Terms will indicate their effective date.

14. Governing Law

These Terms are governed by the laws of Maryland, United States, without regard to conflict-of-law principles, except where applicable consumer-protection laws require otherwise.

15. Apple App Store Terms

If you download OverPocket through Apple's App Store, you acknowledge that these Terms are between you and Overpocket Inventory, not Apple.

Apple is not responsible for providing maintenance or support for OverPocket. To the extent required by Apple's applicable terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Your use of Stow must also comply with Apple's applicable usage rules.
